T To request the confidentiality of your address, you must follow a few procedures. First, there is a way to receive an Address Confidentiality Order through the court. If you tell the Family Court Clerk that you want to keep your address secret, the clerk will provide you with a document called an Address Confidentiality Affidavit. You can then fill out, sign, and submit this document. If the Address Confidentiality application is accepted, the court will issue an Address Confidentiality Order. If that happens, the address will not be seen in any court documents.

T The New York State Address Confidentiality Program exists in New York State. This program is free of charge for domestic violence victims who have moved to a new location or are planning to move for safety reasons. If adopted into the program, the address will be secret in court documents, government agency records, and driver’s licenses, as well as in unemployment insurance or public assistance applications. This program is required for application and enrollment.

The meaning of Domicile Confidentiality

I If you have received an address confidentiality order or become a participant in the New York State Confidentiality Program, the word “confidential” will be used in the court case record instead of the actual address. This includes various documents from the family court and all documents sent to the other side. If you have received an order to ensure the confidentiality of your address, the documents sent from the court will be sent to the Designated Agent for Service. The person in charge of the delivery may be a lawyer or family court clerk, or anyone over the age of 18. You will be responsible for sending all documents to the plaintiff through the designated delivery person. If you are a registered participant in the New York State Address Confidentiality Program, the court documents will be sent to the Secretary of State’s office in Albany and subsequently delivered to the plaintiff via certified mail.
